Walmart blames Tracy Morgan for his injuries

Back in June, news broke out that comedian Tracy Morgan was in a car accident that took the life of comedian James McNair and seriously injured Morgan along with two other passengers. The limousine that Tracy Morgan and his friends were in was hit by a Walmart truck traveling at 65 mph in a 45 mph zone at 1 a.m. in New Jersey. It was later revealed that the truck driver behind the wheel may have been up for more than 24 hours.

Tracy Morgan was critically injured and was in a coma. After waking up he has had to deal with rehab and getting back in the groove of everyday life, and his lawyers eventually filed a lawsuit against Walmart in mid-July for negligence knowing the driver had been working for 24 hrs, which led to the accident. The truck driver fell allegedly fell asleep at the wheel as he was driving from Georgia to a Walmart distribution center in Delaware, and rear ended the limo in a construction zone.

Recently Walmart’s lawyers decided to switch the focus on the accident to Tracy Morgan and everyone in the limousine by saying the injuries could have been minimized had Morgan and company worn their seat belts prior to the crash.

“[P]laintiffs’ injuries, if any, were caused, in whole or in part, by plaintiffs’ failure to properly wear an available seatbelt restraint device,” Wal-Mart’s response to Morgan’s complaint reads. “By failing to exercise ordinary care in making use of available seatbelts, upon information and belief, plaintiffs acted unreasonably and in disregard of plaintiffs’ own best interests. Accordingly, all or a portion of the injuries could have been diminished or minimized by the exercise or reasonable conduct in using their available seatbelts

We all know how important it is to wear your seat belts when in cars, but with a driver falling asleep in a huge truck, I don’t think seat belts are the most important thing to focus on when lives are on the line on the road.
